He wants to know what the Pre-Delivery Inspection of common areas comprises and what the official process is for dealing with his contractor.<\/strong><\/p>\n<\/div>\n<p>\u00a0<\/p>\n<h3>When, how and why to do a Pre-Delivery Inspection of common areas?<\/h3>\n<div>\n<p>As the syndicate of co-owners is no longer under the control of the contractor, the latter sends the management council of co-owners a notice of completion of the work. Once the management council has received this notice, it must call in a building professional to perform the Pre-Delivery Inspection of common areas. This inspection is carried out by this professional, the contractor and the management council using the Pre-Delivery Inspection form. The professional completes the Pre-Delivery Inspection form\/report in which he establishes the date of receipt of the common areas and denounces, on the one hand, the work to be corrected or completed. This document constitutes the acceptance of the common areas and marks the beginning of certain guarantees. The document prepared by the professional constitutes the reception of the common areas. If, on the other hand, major work remains to be done, the professional appointed by the management council cannot proceed with the acceptance of the common areas. The management council must then immediately ask the contractor in writing, with a copy to the administrator, to complete the work by sending him the list prepared by the professional.<\/p>\n<\/div>\n<p>\u00a0<\/p>\n<div>\n<h3>Is there a specific deadline to be observed?<\/h3>\n<\/div>\n<p>Certainly yes ! The management council has a maximum period of six months to complete the reception of the common areas after the notice of end of work if the following four conditions are met:\u00a0<strong>1.<\/strong> The work relating to the common areas has been completed;\u00a0<strong>2.<\/strong> The management council is formed and is no longer under the control of the contractor;\u00a0<strong>3.<\/strong> The completion of work notice sent by the contractor to the management council, when the latter was no longer controlled by the contractor, informed the management council of the completion of the work and of its obligations with regard to the receipt of the works ;\u00a0<strong>4.<\/strong> Six months have elapsed since the receipt of this notice by the management council and the latter, without reason, has not received the common portions.\u00a0If any of these four conditions is not met, there is no presumed reception of the common areas. The guarantee is therefore not effective. This period is provided for in the Regulation respecting the guarantee plan for new residential buildings (under certain conditions).<\/p>\n<p>\u00a0<\/p>\n<h3>What if the contractor does not agree on certain points with the professional appointed by the management council?<\/h3>\n<div>\n<p>In the event of disagreement between the management council representative and the contractor on the work to be completed or corrected, the professional you have appointed for the Pre-Delivery Inspection will be able to enlighten the discussions between the management council and the contractor on the reading of the elements to be corrected in order to meet the requirements of the guarantee administrator.<\/p>\n<p>\u00a0<\/p>\n<\/div>\n<h3>What are your recommendations for choosing the professional?<\/h3>\n<p>My recommendation is that of the R\u00e9gie du B\u00e2timent du Qu\u00e9bec (RBQ), namely that an architect, engineer or technologist should be tasked. They are the only professionals authorized to perform this type of Pre-Delivery Inspection. Of course, the company&#8217;s experience and reputation are also important factors. I usually say that a report looks like the professional who wrote it. If the report is thin and not very detailed, I would personally be a little confused. For example, when we do Pre-Delivery Inspections for 10-storey buildings, our reports are easily close to 350 pages. Everything should be noted: from puddles in garages, to cracks in structural elements, to anchor holes in unclogged scaffolding. This can sometimes seem trivial but this kind of detail can lead to major deficiencies in the future with risks of deterioration that could affect the safety and sustainability of your building. Moreover, a good report is a report which makes the observations and recommendations intelligible to the uninitiated such as the members of a condominium management council. Findings should be as explicit and as easy to understand as possible. This is why it is important to have a detailed report, illustrated with supporting photos but also including a mapping of fault plans. On the one hand, it will make it easier to understand the observations and on the other hand, it will save time to follow up on corrective work. It is therefore on these &#8220;details&#8221; that you can question the firm you wish to mandate to verify its professionalism.<\/p>\n<p>\u00a0<\/p>\n<h3>What if the management council has doubts about the professionalism of the contractor?<\/h3>\n<p>If you have any doubts about the work of the contractor, I recommend organizing a site supervision by an expert engineer. The latter will check each of the failures highlighted by the report until they comply with the Codes and standards in force. The Pre-Delivery Inspection of common areas is therefore an important step before accepting the work. This is all the more important since unrecognized deficiencies can affect your insurance policy, the cost of premiums and the amounts of deductibles.
